tshark: check if file exists too

Vladimír Beneš requested to merge vb/tshark_assure_we_have_file into main

When "empty" is not visible with command "file /tmp/tshark.log" in "150" seconds might have ended with error: /tmp/tshark.log: cannot open `/tmp/tshark.log' (No such file or directory)

so we need to check the ouptut for cannot or empty
